Terms of Service

1. Acceptance of Terms

By creating an account or using HyLokal (the website, the apps and HyLokal Shop), you agree to these Terms of Service ("Terms"), our Privacy Policy and our Community Guidelines. If you do not agree, do not use HyLokal. These Terms apply to everyone: visitors, members, sellers, buyers, affiliates, event organisers and advertisers.

2. Who can use HyLokal

You must be at least 13 years old. We ask for your date of birth when you sign up; it is not shown on your profile. If you are under 18, you need the permission of a parent or guardian. Some features are only for adults who have verified their identity: selling in HyLokal Shop, receiving affiliate commission and selling paid tickets.

3. Your account

Keep your password safe and don't share your account. You are responsible for everything done with it. You can keep several of your own accounts signed in on one device and switch between them. Tell us at [email protected] if you think someone else used your account.

4. Your content

You own what you post: photos, videos, captions, comments, messages and listings. By posting, you give HyLokal a non-exclusive, worldwide, royalty-free licence to host, show, share and promote it on HyLokal (including in the feed, Pulse, HyMap, search and Discovery) and to make technical copies needed to run the service, such as resized images and video versions. The licence ends when you delete the content or your account, except for copies others already shared or that we must keep by law.

You are responsible for what you post. It must follow the Community Guidelines. We may remove content or limit accounts that break these Terms or the Guidelines.

5. Location

HyLokal is built around real places. Posts are created with your device's camera and location: the place you post from is attached to the post, its area name is shown, and the exact spot can be seen by others and on HyMap. This is required to post.

You can add Private places (for example home, work or school) in your settings. Posts taken inside a private place never show the exact spot to anyone, including you, and are not shown on HyMap; posts close to it show a spot moved a little. Features that share your live location are always optional and only shared with the people you choose.

6. Tags and mentions

You can tag people on your posts and mention them with @. Tag and mention people respectfully. Every member chooses who can tag or mention them and can remove themselves from a post they were tagged on.

7. HyLokal Shop

Sellers must apply and verify their identity before selling. You must describe products honestly, own the right to sell them, keep prices and stock correct, and ship on time. Selling anything illegal where you or the buyer live is not allowed, including weapons, drugs, counterfeit or stolen goods. Products are sold to buyers in the seller's own country.

Buyers pay online at checkout. Every order is delivered by a courier; the seller's pickup address and the buyer's name, phone number and address are shared with the courier to deliver it. Cash on delivery and self-pickup are not offered.

HyLokal provides the place to buy and sell. The contract for each sale is between the seller and the buyer. Sellers are responsible for their products, refunds and returns under the law of their country. We may hold, cancel or refund orders, and suspend sellers, to protect buyers.

8. Affiliates

Any member can add products from sellers who allow it to their showcase and tag them on posts. When someone buys through your post or link within the attribution period, you may earn the commission the seller set. Commission is held for 14 days after delivery to allow for returns, and is paid only after you verify your identity (18 or older) and add a bank account. HyLokal shows "Earns commission" on product tags in your posts. You must not hide paid promotion or create fake orders. We may withhold commission from orders that are cancelled, refunded or fraudulent.

9. Events and tickets

Organisers must publish real events with honest dates, places and ticket details, and tell attendees about changes or cancellations. Selling paid tickets requires identity verification. Tickets are personal and may be checked with a QR code at the door.

10. Ads and Promote

Ads and promoted posts are paid in advance from your HyLokal credit. A daily budget is spent as people see your ad; unspent budget is returned to your credit when the campaign ends or is stopped. Ads must be truthful, legal and follow the Community Guidelines (no illegal products, adult content or gambling). We may reject, pause or remove any ad. Ads and promoted posts are labelled "Sponsored".

11. Reporting and moderation

You can report posts, comments, people and chats. Reports are private. Our team reviews them and may remove content, limit features, suspend or ban accounts. When you report a chat, our team can read the messages in that chat to review it. To appeal a decision, email [email protected].

12. Things you must not do

• Scrape, copy or collect data from HyLokal without written permission
• Try to access accounts, data or systems you are not allowed to
• Send spam, create fake accounts, or fake likes, follows, reviews, orders or reports
• Interfere with how HyLokal works or its security
• Use HyLokal for anything illegal or to harm others

13. HyLokal's property and other services

The HyLokal name, logo, design and code belong to us. Maps use OpenStreetMap data (© OpenStreetMap contributors). Discovery posts use photos from Wikimedia Commons with their authors and licences credited. Links to other services (for example navigation apps) are covered by those services' own terms.

14. No guarantees

HyLokal is provided "as is". We work to keep it running and safe, but we do not promise it will always be available or error-free, and we are not responsible for what members post, sell or do. Road, safety and other reports from members may be wrong; always use your own judgement.

15. Limitation of liability

To the extent the law allows, HyLokal is not liable for indirect, incidental, special or consequential losses, including loss of data, revenue or reputation, arising from your use of HyLokal. Nothing in these Terms limits rights you have under consumer law that cannot be excluded.

16. Indemnity

You agree to cover HyLokal for claims, damages and costs (including legal fees) that come from your content, your sales or your breaking these Terms.

17. Ending your account

You can delete your account at any time in Edit profile. Your account is hidden at once and permanently removed after 30 days, unless you sign in again before then. Upcoming events you organise are cancelled straight away and ticket holders are told. We may suspend or end accounts that break these Terms. Orders, payouts and records we must keep by law are kept as long as required.

18. Governing law

These Terms are governed by the laws of the place where HyLokal's operating company is registered, and its courts handle disputes. If the law of your country gives you the right to use its own laws or courts, nothing here takes that away.

19. Changes

We may update these Terms. We will tell you about important changes in the app before they apply. Using HyLokal after a change means you accept it.
